All parents need to provide consent for photography and film to be taken of their child in accordance with the terms of our Digital Image Policy.

Introduction

The school has a duty of care to provide a safe environment for our pupils. Some of the photography in school is in respect of necessary administration and the safety of pupils, such as CCTV and pupil identity purposes. While we are aware of the risks of image misuse and the right of individuals to privacy, we believe that the school needs to balance this against positive value of professional, quality images of pupils in celebrating and promoting the school as an enjoyable, vibrant place to learn. Media uses, including photos of pupils at work or playing games, may include the school website or as part of a school prospectus or magazine.

Good pictures and film of the school and our children can help in putting the school at the heart of the local community and enhance our reputation. Throughout the school day various photographs are taken of the children which may later be featured in the School's publications such as our magazine Newlandian, newsletter Newsreel, prospectus, or website and possibly in external media (both published and online) promoting the school.

The School believes that the responsible use of children’s images can make a valuable contribution to the life and morale of the school, aid pupil motivation and help parents and the local community identify and celebrate the school’s achievements.

Digital Image Policy

Full details of the school's policy on the use of photographs and video within the school are detailed in our Digital Image Policy. This policy is intended to minimise the risks that young people can be exposed to through the misuse of images. The policy takes account of data protection and child protection issues and covers the procedures for taking, utilising and publicising images of pupils. Digital Images include photographs, film or video (including video conferencing), CCTV and the use of images acquired via mobile phones, cameras, tablets and other devices. 

How We Use Images

Good pictures of the school and its children can help in putting the school at the heart of the local community and enhance its reputation.

  • Images may be used internally in school publications such as the school magazine Newlandian, our termly newsletter Newsreel, Pre-Prep weekly newsletter, prospectus, and website, Firefly and in external material publicising the school.
  • Images and video may also be used on public websites such the school website, the school’s social media profiles such as Twitter and Facebook and other industry led external websites. 
  • Images may also be used within marketing material for the school such as our prospectus, posters and banners. Images may further be used in external publications such as magazines and newspapers promoting the school.

Our main guidelines for the safe use of digital images are that where they are used:

  • Names of pupils will not appear on any external websites (including the school’s website) and social media. (Occasionally express and direct permission may be sought in respect of significant news items or editorial).

  • Full names may be used on Newsreel and Newlandian the school’s annual and termly publications as from a safeguarding perspective these are not online publications.

  • Full names may be used on Firefly as this is not a public site and access is restricted to the school community only.

  • Names will not appear in any other publications (unless express permission is sought beforehand).

Where Consent Has Not been Given

For those parents who feel unable to provide consent for images of their children to be used in a particular way, we would like to outline the process so that parents are aware of how we will manage this and the implications for your children or images of them:

  • If you have indicated that you do not wish your child to be photographed or filmed at all they will be asked to stand aside during all photo and filming opportunities. This would include general classroom and playground images as well as school events, productions, and school trips etc.
  • If you have indicated that you do not wish for images to be used on the school’s website or social media (remember, we never use their names) we may ask your child to stand aside from the frame prior to taking photographs or filming or we will doctor the image to ensure that the pupil is not recognisable using pixilation prior to posting.
  • Before a photograph is used for in-school or marketing purposes we need to firstly identify the children featured, carefully check the level of parental consent provided against the intended use of the image and then apply pixilation to the part of the image featuring the faces of any non-consented children. Whilst we try to avoid using images of children which feature children for whom we do not have parental consent inevitably some of the very best images that perfectly capture school life do include them and often it is inevitable.

GDPR & Consent

Under The EU General Data Protection Regulation (GDPR) the school is required to demonstrate specific consent from parents in relation to the use of photography and film. To ensure that parental consent is evident and clear we require completion of our new Pupil Photography and Consent Form below for every pupil in the school. You must complete a separate form for each of your children. You may also change your consent at a later date using this form.

This form is subject to the provisions of GDPR which includes rules on giving privacy information to those whose data is held by an organisation. These requirements ensure that privacy information is clear and understandable. Our Privacy Policy is detailed on the school’s website and details the overall privacy responsibilities of the school.

IAPS

Please also note the IAPS Pupil Image Policy on the right hand side of the page which sets out IAPS’ approach to the use of photographic images supplied to the association by member schools, and the taking of images by IAPS staff and professional photographers for IAPS sports events.

Advice for Parents: School Events

Under Data Protection & GDPR, photos and videos taken by parents, such as at sports days or school performances, are counted as being taken for ‘personal use’ and are therefore not covered by the GDPR. However it is possible that they will also capture images of children other than their own. A parent/carer publicly sharing images of other people’s children with no controls on privacy may be a breach of data protection rules and parents are therefore are asked not to share or publish images on social media or elsewhere online, for safeguarding reasons. Sharing images of their own children is not a breach of data protection rules. 

The school will decide if parental/carer photography and video is appropriate on an individual event basis depending on the nature of the activity and any risks posed to children and staff taking part.

The school will ensure that parents/carers are aware of any restrictions on photography and will publicise this prior to the event and/or bring it to the attention of parents/carers at the start of the event.

Parents/carers have the right to ask for their child not to be photographed. On some occasions that may result in the child being unable to take full part in an activity.

The School believes that the responsible use of children’s images and film makes a valuable contribution to the life and morale of the school, aids pupil motivation and help parents and the local community identify and celebrate the school’s achievements.
